General Terms and Conditions of Sale

1. Preamble
   These General Terms and Conditions of Sale (GTCS) apply to all orders placed on the website www.akasa-biarritz.com. By placing an order on the Site, the customer fully accepts these GTCS without reservation. The Site is operated by AKASA Biarritz, located at 11 rue Julien Castanier, 64600 ANGLET, and registered under number 934 345 836 R.C.S. Bayonne.

2. Products
   The products offered for sale are those described on the Site, within the limits of available stock. Product descriptions are as accurate as possible. However, if errors or omissions occur, Akasa cannot be held responsible.

3. Prices
   Prices are shown in euros, including all taxes (VAT), excluding delivery fees. Akasa reserves the right to change prices at any time, but products will be billed based on the rates in effect at the time the order is confirmed.

4. Order
   The customer places an order online from the catalog available on the Site. Placing an order implies acceptance of the product prices and descriptions. Once the order is confirmed, a confirmation email will be sent to the customer. Akasa reserves the right to cancel or refuse any order from a customer involved in a dispute concerning payment of a previous order.

5. Payment
   Orders are paid via the available payment methods on the Site (credit card, PayPal, etc.). Payment is secured via SSL protocol. The order will be shipped once payment is received.

6. Delivery
   Products are shipped to the address provided by the customer at the time of the order. Akasa commits to dispatch items within the business day following order confirmation. Delivery charges are the responsibility of the customer and are indicated at checkout. In case of delivery delays due to force majeure (strikes, weather, etc.), Akasa cannot be held liable.

7. Right of Withdrawal
   In accordance with applicable legislation, the customer has 14 days from receipt of the order to exercise their right of withdrawal without providing a reason or incurring penalties. Products must be returned in their original condition and complete (packaging, accessories, instructions). Return shipping costs are the responsibility of the customer.

8. Warranty and After-Sales Service (SAV)
   Products sold on the Site are covered by the legal warranty of conformity and the warranty against hidden defects, in accordance with current legislation. If a product is found to be non-compliant, it may be returned, exchanged, or refunded.

9. Liability
   Akasa cannot be held responsible for any damage resulting from use of the Internet, such as data loss, intrusion, virus, service interruption, or other involuntary problems.

10. Personal Data Protection
    Akasa is committed to protecting customer data in accordance with the General Data Protection Regulation (GDPR). The information collected is necessary for order management and improving services. Customers have the right to access, rectify, or delete their personal data.

11. Intellectual Property
    All elements on the Site (texts, images, graphics, logos, icons, etc.) are protected by copyright. Any unauthorized reproduction or use is prohibited.

12. Disputes and Applicable Law
    These GTCS are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. If no amicable resolution is found, the dispute will be brought before the competent courts.
